1S-/ 1SB-LSD: Ban imminent – Federal Council decision on November 21, 2025 very likely

For months, there has been debate about when 1S-LSD and related derivatives will finally fall under the New Psychoactive Substances Act (NpSG). Now it's clear: The crucial regulation is available – and the Federal Council is expected to approve it on November 21, 2025. This would mean that the ban on 1S- and 1SB-LSD is only a matter of weeks away .
Brief overview
- The draft regulation ( “Sixth Regulation amending the Annex to the NpSG”, BR-Drs. 534/25 ) is officially available.
- He extends the LSD substance group (Δ9,10-ergolene) in Annex 1 No. 5.2 to include the element silicon – expressly because of the occurrence of 1-S-LSD.
- This will also include silylated LSD derivatives (i.e., chemically modified variants with silicon) in the future.
- The Federal Council is expected to vote on the regulation on November 21, 2025.
- Following approval, the ban is published in the Federal Law Gazette – it then applies the next day.
- Important: The NpSG prohibits the manufacture, trade, distribution and supply, but not the possession (§ 3 NpSG).
Background: From the September meeting to the new draft
In our last post (“ No ban on 26.09.2025 ”) we explained that the Federal Council had not issued a ban regulation at that time, but only a statement on the ongoing amendment to the NpSG .
The Federal Government rejected the broad “general clause” on LSD derivatives proposed there, citing the principle of legal certainty (Article 103, Paragraph 2 of the Basic Law) – and instead announced a separate regulation to specifically cover new LSD variants.
This regulation is now available: BR-Drs. 534/25 , received on 9 October 2025 .
It was assigned to the Health Committee of the Federal Council as the lead committee and is currently undergoing committee proceedings.
What the new regulation governs
The revised version of the NpSG annex clarifies and expands the LSD substance group. Crucially, there is a seemingly small but legally far-reaching change:
"In section 5.2 letter a, the term 'silicon' is added due to the increased occurrence of 1-S-LSD."
That means:
The chemical definition will in future also allow compounds in which silicon is present in the substituent (R1) – i.e., so-called silylated amides.
This clearly includes substances such as 1S-LSD and 1SB-LSD in the existing LSD group.
Trade names or abbreviations (“1SB”) are irrelevant – only the chemical structure matters.
Why November 21, 2025 is considered the decision date
- The regulation is complete and has been correctly assigned to the relevant committee.
- The agenda for the Federal Council meeting on November 21st will be published approximately ten days in advance.
- Similar NpSG plant regulations have been regularly adopted unanimously or by majority vote in recent years – most recently in June 2024 (approval on June 14, promulgation on June 26).
- There are no political or legal objections that would prevent approval.
Conclusion
The Federal Council is expected to adopt the 6th NpSG Plant Ordinance (BR-Drs. 534/25) on November 21, 2025.
This adds the element silicon to the LSD substance group (Δ9,10-ergolene) – specifically to include 1S-LSD and similar silylated derivatives.
This effectively means that the ban on 1S and 1SB LSD is now a certainty.
Implementation will take place immediately after the announcement – probably by the end of November or the beginning of December 2025.
Possession remains – as with all NpSG substances – unpunished.

The New Psychoactive Substances Act penalizes the handling of substances in commerce (production, trade, distribution), but not private possession or consumption .
