Many questions arose surrounding the Federal Council meeting of September 26, 2025 : Was 1S-LSD banned β yes or no? What actually happened on September 26, 2025
At the 1057th session of the Federal Council, item 29 on the agenda was the draft law to amend the New Psychoactive Substances Act (NpSG ). The Federal Council adopted a statement on this matter, which recommends, among other things, that the LSD regulation (Annex 1, No. 5.2 NpSG) be formulated more generally β with reference to the basic structure Ξ9,10-ergolene and open substitution possibilities β so that future derivatives ( 1S-LSD is cited as an example) would also be covered. This is a recommendation, not a change in the law.
The German Federal Government has rejected this expansion, citing the principle of legal certainty (Article 103, Paragraph 2 of the Basic Law). The reasoning, in short, is that a very broad, abstract formulation would open up "an infinite number of possibilities" and make it difficult for legal practitioners to predict exactly what is punishable. At the same time, the Federal Government announces that it will expand the annex to the New Psychoactive Substances Act (NpSG ) to include further substances by means of a separate regulation β new LSD derivatives (including 1-S-LSD) are explicitly mentioned.
What the NpSG amendment actually regulates (and what it doesn't)
The government draft adds a new Annex 2 (positive list) to the NpSG and amends, among other things, Sections 2β4/7 . Particularly relevant:
β Nitrous oxide : recorded as a pure substance; preparations in containers with > 8 g ββ.
β GBL and BDO : recorded as pure substances; preparations > 20% .
β Distribution rules: including a ban on mail order/vending machine sales for the new Annex 2 substances and U18 protection regulations ; at the same time, exceptions for recognized commercial, industrial and scientific uses .
β LSD derivatives are not part of this draft law; currently, only the recommendation of the Federal Council and the Federal Government's response exist on this matter (see above).
The draft also stipulates: "enters into force three months after its promulgation" β this applies to this amendment (nitrous oxide/GBL/BDO).
What does this mean for 1S-LSD (today β and in the future)?
Today: There is no new prohibition on 1S-LSD. The Federal Council's decision of September 26th is a statement , not a ban.
From a long-term perspective, there are two paths:
1. Legislative process (current amendment): It remains to be seen whether the Bundestag will adopt the LSD amendment proposed by the Bundesrat. Even if it does: The law would only come into effect three months after its promulgation β the legislative timetable makes it realistic for it to enter into force no earlier than spring 2026. (This is a timeframe, not a guarantee.)
2. Regulatory route (Β§ 7 NpSG): The Federal Government has announced its intention to add further substances to the NpSG annex by regulation β explicitly including new LSD derivatives (including 1-S-LSD) . There is no published draft or date for this regulation yet ; we are monitoring the situation closely.
Why many assumed the "ban on September 26th"
In the run-up to the vote, announcements and expectations circulated, partly because the expert committee at the BfArM (Federal Institute for Drugs and Medical Devices) had addressed the topic on May 13, 2025 , and because in previous years some amendments to the NpSG (New Psychoactive Substances Act) had actually been implemented by regulation (and thus more quickly). However, on September 26, the vote was not on a draft regulation , but on a proposed amendment to the law β therefore, no immediate ban .

1. Bundestag : Discussion of the NpSG amendment (nitrous oxide/GBL/BDO) with the possibility of addressing LSD issues at the legislative level .
2. Federal Government : parallel announced draft regulation for the targeted expansion of the NpSG annex β including new LSD derivatives (also 1-S-LSD) .
3. Promulgation : Law published in the Federal Law Gazette ( 3-month grace period), regulation issued after promulgation (typically without a long grace period). Specific dates depend on the respective procedural steps.
